Legislation Introduced to Penalize MCOs Which Don’t Pay On Time – Money Goes to Provider

House Bill 1420 was introduced into the legislation session yesterday by House Representative Mando Martinez.  The bill is captioned as “Relating to the imposition of a late payment penalty against Medicaid managed care organizations that fail to timely pay certain physician and provider claims.”

The bill is an amendment to the Government Code which charges an MCO an additional 20% of the outstanding payment amount which goes to the provider if the MCO has not paid 15 days after the payment time limit.  See a copy of the bill below.

Rep. Martinez is the representative for State District 39 in the Rio Grande Valley and has an office in Weslaco.

  • Kind of late for what MCOs had not paid and the recoups moneys taken so far.

    I wish we providers were more compromised with our profession and had one universal legal contract agreement to present to all insurances . A no modifiable contract that protects our providers right of practice against any corporate trying to rule over our practices.

    We should not have to be dealing l with all this mess.
