Medicaid Fraud Indictment Against NY Nurse is Dismissed – No Evidence

An Albany judge dismissed an indictment against a nurse charged in a Medicaid fraud, saying there was no evidence she knew that the owners of the facility she managed had falsely certified its regulatory compliance.

Gelena Deverman, 35, was charged in a $6 million fraud in connection with her management of a Brooklyn nursing home, a felony punishable by 25 years in jail.

Deverman herself was not accused of pocketing any money. Rather, New York’s Medicaid Fraud Control Unit, a division of the New York Attorney General’s office, said she allowed bills to be submitted to Medicaid knowing the facility was not in compliance with rules regarding the employment of unlicensed social workers.
