A district court judge on Wednesday handed state Medicaid regulators another decisive courtroom loss, adding one more notch to the Health and Human Service Commission’s Office of Inspector General’s unenviable losing streak pursuing dentists and orthodontists it claims have bilked the federal entitlement program.
In fact, regulators have yet to claim a single outright court victory in what they initially claimed was a multi-million-dollar pattern of fraud committed by dozens of dentists and orthodontists. Many of the cases in which practitioners were alleged to have improperly billed millions of dollars have settled out of court for pennies on the dollar.
