Xerox Asks Texas High Court To Limit $1B Medicaid Fraud Suit 

Law360, Dallas (February 21, 2017, 6:33 PM EST) — Xerox Corp. accused Texas of using a “web of lawsuits” to divide and conquer in a $1 billion civil Medicaid fraud suit over allegedly unneeded orthodontics, telling the Texas Supreme Court in a brief that the state had brought “coercive fraud suits” that need to be checked by the high court.

Xerox and its claims processor subsidiary Xerox State Healthcare LLC face allegations under the Texas Medicaid Fraud Prevention Act that they didn’t properly vet orthodontics claims and approved payment for medically unnecessary procedures. In the brief, filed late Thursday, Xerox argued Texas is wrongfully blocking the company from designating the dentists who treated patients in the alleged fraud scheme as responsible third parties. Texas has separately sued the dentists.
